If you're starting a business in Texas, you may need to obtain a Texas tax ID number, otherwise known as a sales tax permit. This state tax ID, which can be acquired by applying with the Texas comptroller's office, is required for all entities, including sole proprietorships, partnerships and corporations, that intend to offer taxable goods and/or services. Step 1 If you plan to hire employees, apply for your federal Employer ID number (EIN) from the IRS before you apply for your Texas ID number. To receive an EIN instantly, apply online through the provided application on the IRS's website. The application is supported by most Internet browsers, but you will need Adobe Reader installed on your computer to view the application. The form contains basic questions about your business, including the legal name of business, your name, business address and type of entity. If you do not feel comfortable filing out the application online, you may obtain an ID by calling the Business and Specialty Tax Line or downloading and mailing or faxing the application to the designated IRS service center for your state. Step 2 You must also designate an appropriate NAICS (North American Industry Classification System) code for your business. A NAICS code is used by the U.S. Office of Management and Business to help collect and analyze U.S. economic data. To determine the correct NAICS, use the provided search tool, or peruse current code titles on the official NAICS website. Step 3 If forming a corporation in Texas, you need to file a certification of formation with the Texas Secretary of the State's office before you can successfully apply for a state tax ID number. This form can be obtained from the Secretary of State's office and must be filed with a $300 fee. Step 4 Obtain the required tax registration application from the Texas Comptroller's office. Pick up an application in person from one of the field enforcement offices around the state, request the form by phone, download the application from the state comptroller's website or fill out the application with the online sales tax registration system. To complete the form, provide the type of entity; the legal name and address of your business; the names, addresses and social security numbers of all owners, partners and corporation officers and directors; and your NAICS code. Next, print the signature form, which each owner, partner or officer must sign and date. Then fax or mail the form to the comptroller's office. Your sales permit will be issued in two to three weeks. |
